Real Estate&#8221;<\/a><\/p>\n<p><a href=\"http:\/\/www.rgs.mef.gov.it\/_Documenti\/VERSIONE-I\/Selezione_normativa\/R-D-\/RD18-11-1923.pdf\"><span style=\"font-weight: 400;\"> R.D. no. 2440 of 18\/11\/1923 \u201cNew Provisions Regarding the Administration of the State&#8217;s Assets and Financial Accounting\u201d<\/span><\/a><\/p>\n<p><a href=\"http:\/\/www.rgs.mef.gov.it\/_Documenti\/VERSIONE-I\/Selezione_normativa\/R-D-\/RD23.05.24.pdf\"><span style=\"font-weight: 400;\"> R<\/span><span style=\"font-weight: 400;\">.D. no. 827 of 23\/05\/1924<\/span><span style=\"font-weight: 400;\"> \u201cRegulation for the Administration of the State&#8217;s Assets and Financial Accounting\u201d<\/span><\/a><\/p>\n<p><a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/articoli\/artt-436-438-legge-30-dicembre-2004-n-311-disposizioni-la-formazione-del-bilancio-annuale-pluriennale-dello\"><span style=\"font-weight: 400;\"> Art. 1<\/span><span style=\"font-weight: 400;\"> paragraphs 436, 437, 438 of \u00a0Law no. 311 of 30\/12\/2004, \u201cProcedures for the Sale of Real Estate Assets<\/span><span style=\"font-weight: 400;\">\u00a0Owned by the State\u201d<\/span><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" class=\"alignnone wp-image-59\" src=\"https:\/\/dev.investinitalyrealestate.com\/wp-content\/uploads\/2026\/03\/icona_procedura.svg\" alt=\"\" width=\"79\" height=\"80\" \/><\/p>\n<h2>Procedure<\/h2>\n<h3>Launch of a Call for Tender<\/h3>\n<p>The<a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/procedure-for-the-alienation-of-a-public-asset\"> Procedure for the Sale of Publicly-Owned Real Estate Assets<\/a>, already included in the\u00a0<a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/real-estate-alienation-and-development-plan\">Real Estate Sale and Development Plan<\/a> usually begins with the publication of a Call for tender on the institutional website of owner of the public asset. Any investor interested\u2013 according to the nature of the call\u2013 can:<\/p>\n<ul>\n<li>View any document concerning the real estate asset and carry out on-site verification. During the verification, the investor shall receive all useful documentation in order to verify urban, building and Land Registry&#8217;s conformity and to detect the absence of burdens, constrains and encumbrances that would limit its free use;<\/li>\n<li>Request clarifications to the Person responsible for the procedure on behalf of\u00a0the owner of the property (the individual appointed as reference by public owner for the sale procedure; its name shall be specified in the Call for tender);<\/li>\n<li>Make a <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/binding-offer\">binding offer<\/a>\u00a0within the time limit and according to the modalities specified in the call for tender.<\/li>\n<\/ul>\n<p><b>Call for Tender&#8217;s Deadline<\/b><br \/>\n<a href=\"#_ftnref1\" name=\"_ftn1\"><\/a><\/p>\n<p>If not otherwise expressed in the call, the tender is valid for 180 days from the expiry date for the submission of the tender. This period is meant to safeguard the competitor, preventing any eventual lengthiness of the procedure to become detrimental. In case no contract has been signed after the expiry of such period, the competitor can waive his tender or confirm it, either tacitly (e.g. by signing the contract) or expressly, also following a request from the Contracting Authority. Once the tender is confirmed, the effectiveness of any eventual guarantee issued during the participation to the call shall be extended.<\/p>\n<h3>Identification of Best Tender<\/h3>\n<p><span style=\"font-weight: 400;\">The call is usually won by the subject who offers the highest price.<\/span><\/p>\n<p><strong>Exclusion Criteria and Proof of Compliance<\/strong><\/p>\n<p>With reference to the general requirements laid down in the current legislation for participating in <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/public-tender\">public tenders<\/a>, notwithstanding the requirement to verify any eventual provision of each specific call, it is necessary to specify that:<\/p>\n<ul>\n<li>Usually, by moral requirements, reference is made to those provided for in Art. 80, D.L. no.50 of 18\/04\/2016 &#8220;Code of Public Contracts&#8221;; the competitor shall prove to hold the aforementioned requirements when taking part in the call, to be verified by the Contracting Authority once the tender has been submitted. More specifically, public administrations may request the following documents: a certificate issued by the Criminal Records Office or, if unavailable, an equivalent document issued by the judicial or administrative authority of the Member State or of the Country of origin in which the envisaged requirements are met; appropriate certification issued by the competent fiscal authority and, as far as social security contributions are concerned, the certificate of social security compliance automatically acquired by the public administration from social security institutions pursuant to current legislation or, if unavailable, an equivalent certificate issued by competent authorities of other States.<\/li>\n<li>Economic and financial standing of the economic operator, declared upon taking part in the call, can be proved through one or more of the following: appropriate bank declarations or, if any, evidence of relevant professional risk&#8217;s indemnity insurance; the presentation of balance sheets or extracts from balance sheets, where publication of the balance sheet is required under the law of the country in which the economic operator is established; a statement of the undertaking&#8217;s overall turnover and, if any,\u00a0of turnover in\u00a0the\u00a0area covered by\u00a0the\u00a0contract\u00a0for\u00a0a maximum of the last three\u00a0financial years available, depending on the date on which the undertaking was set up or the economic operator started trading, insofar as the information of these turnovers is available.\u00a0If,\u00a0for\u00a0any valid reason,\u00a0the economic operator is unable to\u00a0provide\u00a0the references requested by the contracting authority, he may prove his economic and financial standing by any other document which the contracting authority considers appropriate.<\/li>\n<li>The technical capability of the economic operator, declared upon taking part in the call, can be proved, inter alia, by: a)\u00a0a\u00a0list\u00a0of\u00a0the works carried out\u00a0over\u00a0the\u00a0past five years, with\u00a0the sums, dates and recipients,\u00a0whether public or private,\u00a0involved;\u00a0b) the indication of\u00a0the\u00a0technicians or\u00a0technical bodies involved,\u00a0whether or not\u00a0belonging\u00a0directly to the economic operator&#8217;s undertaking,\u00a0especially those responsible for quality control; c)\u00a0a description of\u00a0the technical facilities\u00a0and measures used\u00a0by\u00a0the economic operator\u00a0for ensuring quality\u00a0as well as the\u00a0undertaking\u2019s\u00a0study\u00a0and research facilities;\u00a0the educational\u00a0and professional qualifications\u00a0of\u00a0the\u00a0service provider or contractor and\/or\u00a0those\u00a0of the\u00a0undertaking&#8217;s\u00a0managerial staff,\u00a0provided they\u00a0are not evaluated as award criteria; e)\u00a0a statement of the average annual manpower of\u00a0the service provider\u00a0or contractor and the number of managerial staff for the last three years; f) a statement of\u00a0the tools,\u00a0plant or technical\u00a0equipment\u00a0available to\u00a0the service provider\u00a0or contractor for carrying out the contract<span style=\"font-size: 16px; line-height: 1.5;\">.<\/span><span style=\"font-size: 16px; line-height: 1.5;\"><br \/>\n<\/span><span style=\"font-size: 16px; line-height: 1.5;\">\u00a0<\/span><\/li>\n<\/ul>\n<h3><\/h3>\n<h3><img loading=\"lazy\" class=\"alignnone wp-image-318\" src=\"https:\/\/dev.investinitalyrealestate.com\/wp-content\/uploads\/2026\/03\/icon_tempi.svg\" alt=\"\" width=\"82\" height=\"80\" \/><\/h3>\n<h2>Timing<\/h2>\n<p>30-45 days for completing the selection of\u00a0the buyer.<\/p>\n<p>&nbsp;<\/p>\n<h3><img loading=\"lazy\" class=\"alignnone wp-image-319\" src=\"https:\/\/dev.investinitalyrealestate.com\/wp-content\/uploads\/2026\/03\/icon_costi.svg\" alt=\"\" width=\"80\" height=\"80\" \/><\/h3>\n<h2>Costs<\/h2>\n<p>Costs related to technical-administrative verification and to thetender preparation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Instrument In order to activate the sale procedure for public assets, the property must be listed in the &#8220;Real Estate Sale and Development Plan&#8220;, a document (drafted by Municipalities, Provinces, Regions and other Local Public Bodies, as well as by companies or bodies completely controlled by the aforementioned entities, usually available to the public on [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":0,"menu_order":0,"template":"","vm_categoria":[1788],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v19.0 -
