Which authorisations and certificates do I need?"},"content":{"rendered":"<p>In relation to <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/asset-development\/urban-transformation\" data-original-title=\"\" data-toggle=\"popover\" data-content=\"Instrument Urban transformations may concern: amendments of the use and amendments to urban planning regulation. Any work must comply with applicable urban planning regulations, as well as sector regulations (Art. 12, 22 and 23, D.P.R. no. 380 of 2001). To complete such works, it may be necessary, in order to fulfil the authorisation procedure, to\u2026\">urban transformation<\/a>, if the investor intends to amend the intended use of a property into one which is allowed by the planning regulation, he needs to submit a Certified Notification of Commencement of the Activity (SCIA).<\/p>\n<p>If the investor intends to amend the intended use of a property into one which is not allowed by the current adopted planning regulation in the area, he can submit a request of \u201cAmendment of the Urban Planning Regulation\u201d, requiring the intervention of the competent Authority.<\/p>\n<p>In relation to <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/asset-development\/building-transformation\" data-original-title=\"\" data-toggle=\"popover\" data-content=\"Instrument Building transformation means developing and increasing the value of an asset, carrying out considerable works. \u00a0 Procedure If the development concerns already-sold public assets and requires a building transformation including extensive works, the private investor shall obtain, after submitting the appropriate request, a building authorisation which, according to the cases and the project, can\u2026\">building transformation<\/a>, the investor shall obtain a <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/building-permit\" data-original-title=\"\" data-toggle=\"popover\" data-content=\"The building permit is a building authorisation necessary for the execution of: a) new constructions; b) urban renovations; c) building renovations leading to\u00a0a building partially or completely different from the previous one and that entail changes in the volumes of the buildings or the elevations, or that, concerning only assets included in homogeneous zones A,\u2026\">building permit<\/a> or an <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/agreed-building-permit\" data-original-title=\"\" data-toggle=\"popover\" data-content=\"The agreed building permit is a particular type of building authorisation that can be requested when, according to Art. 28-bis, D.P.R. no. 380 of 2001, &quot;planning requirements can be met with simplified modalities&quot;. In this case, the applicant and the competent public administrative authority shall sign (unless otherwise provided for by regional provisions) an agreement,\u2026\">agreed building permit<\/a>.<\/p>\n<p>Therefore, the private investor\u00a0must submit the\u00a0documentation required to obtain a <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/building-permit\">building permit<\/a> or an <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/agreed-building-permit\">agreed building permit<\/a> to the competent administrative authority (that is the Municipality in which the property is located). As the private investor must prepare all the necessary documentation to obtain the permit, the assistance of professional experts is recommended.<\/p>\n<p>In case of properties having cultural, historical or artistic interest pursuant to\u00a0D.L. no. 42 of 22\/01\/2004, any construction work must be authorised by the competent\u00a0<a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/superintendency\" data-original-title=\"\" data-toggle=\"popover\" data-content=\"The Superintendency of Archaeology, Fine Arts and Landscape represents the branch office of the Italian Ministry of Cultural Assets and has the task to protect Italy's cultural heritage. The organisation of the Superintendencies is regulated by P.M.D. no. 171 of 29\/08\/2014 and M.D. of 23\/01\/2016. Superintendencies' jurisdiction is defined by D.L. no. 42 of 22\/01\/2004\u2026\">Superintendency<\/a>.<\/p>\n<p>In order to realise <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/asset-development\/adjustments-and-improvements\" data-original-title=\"\" data-toggle=\"popover\" data-content=\"Procedure In order to carry out adjustments and improvements on the properties, it is necessary to obtain from the competent authority the building authorisation required by current laws (certified notification of the commencement of the activities or SCIA, communication of the commencement of the activities or CILA, building permit), unless the works can be included\u2026\">adjustments and improvements<\/a> on the properties, the appropriate building authorization shall be obtained from the competent authority (SCIA, CILA, building permit) unless the works can be qualified as \u201cfree building\u201d, i.e. no further authorisations are required.<\/p>\n<p>In case of construction of new buildings, reconstructions or elevations, both total or partial, or any work on existing properties that might affect existing safety, sanitation and energy efficiency conversion standards, a\u00a0certified notification has to be submitted in order to obtain the certification of <a href=\"https:\/\/dev.investinitalyrealestate.com\/en\/vademecum\/art\/glossary\/fitness-for-use\" data-original-title=\"\" data-toggle=\"popover\" data-content=\"The declaration of fitness for use for an asset certifies the fulfilment of safety, sanitation and energy conversion efficiency conditions in the building and systems installed, assessed pursuant to the applicable law, as well as the conformity of the works with the submitted project.\">fitness for use<\/a>.\u00a0The recent regulation introduced by\u00a0<a href=\"http:\/\/www.gazzettaufficiale.it\/eli\/id\/2016\/11\/26\/16G00237\/sg\">Art. 2, D.L. no. 222 of 25\/11\/2016<\/a>, which reformed\u00a0D.P.R. no. 380 of 06\/06\/2001, requires the\u00a0<strong>submission of a certified notification of fitness of use<\/strong>\u00a0to the one-stop desk of the\u00a0Municipality where the property is located. The property can be used starting from the date of submission of the certified notification.<\/p>\n<p>Activities subject to\u00a0<a href=\"http:\/\/www.gazzettaufficiale.it\/eli\/id\/2011\/09\/22\/011G0193\/sg\">fire prevention regulations<\/a>\u00a0are divided into three categories (A, B and C), according to <a href=\"http:\/\/www.gazzettaufficiale.it\/eli\/id\/2011\/09\/22\/011G0193\/sg\">D.P.R. no 151 of 2011<\/a>, depending on the size of the undertaking, on the activity sector, on the existence of specific technical rules and on the need to safeguard the public safety.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In relation to urban transformation, if the investor intends to amend the intended use of a property into one which is allowed by the planning regulation, he needs to submit a Certified Notification of Commencement of the Activity (SCIA).
